Application of the general terms and conditions of service

Any request made to EURL Kléo Phé (hereinafter referred to as “the Service Provider”), whose registered office is located at 1 rue de Stockholm 75008 and registered under SIRET number 93891813300019, is subject to these general terms and conditions of service.

The client’s request or simple expression of consent implies full and unconditional acceptance of these general terms and conditions of service by the client. No special condition may, unless expressly agreed in writing and signed by both the client and the Service Provider, prevail over these general terms and conditions of service.

The Service Provider reserves the right to amend these general terms and conditions of service at any time. The applicable general terms and conditions are those that were validated by the client at the time of booking.

  1. Purpose

The Service Provider is a practitioner in:

Hypnosis

HypnoNatal®

ThetaHealing®

HoloSomatic Bodywork®

Energy work

The Service Provider offers services to clients over 18 years of age, or to minors or protected adults in the presence of their legal representatives, who wish to use these techniques in order to:

free themselves from personal and family patterns

bring about well-being

regain self-esteem and self-confidence

discover their intrinsic qualities

improve performance and potential

ease pregnancy-related discomforts and learn to manage contractions

participate in preparing for childbirth with awareness and serenity

Within this framework, the Service Provider offers the following services:

in person or remote sessions

online masterclasses

in person workshops

the sale of audio and video bundles

online programmes

As the Service Provider does not hold a medical degree, they do not provide medical consultations and cannot issue medical prescriptions. Their role is limited to the practices mentioned above, which the client expressly understands.

  1. Terms and conditions of the sessions
    3.1 Booking confirmation

Sessions or workshops are booked online via the website https://calendly.com/kleophe
.

For any booking to be valid, it must be confirmed by the Service Provider. By signing these general terms and conditions, the client understands that the booking of a session or workshop is only final once it has been confirmed by an email sent to the client specifying the date, time, place, or online connection link for remote sessions.

By signing these general terms and conditions and the client agreement, the client confirms that they have been fully informed of the nature of the session or workshop, the unit price, the duration of the session or workshop, and the payment terms.

Important information: For in person sessions, if the Client wishes to receive a somatic emotional release session (somatic practice) inspired by Holosomatic Bodywork, it is important to note that such a session cannot be carried out in the following situations:

Pregnancy

Asthma

Epilepsy

Retinal detachment, glaucoma

Uncontrolled high blood pressure

Cardiovascular disease, including previous heart attack

Previous diagnosis of manic disorder, bipolar disorder or schizophrenia

Strokes, TIAs, seizures or other brain or neurological conditions

Family history of aneurysms in the immediate family

Use of prescription anticoagulants

Hospitalisation for any psychiatric issue or emotional crisis in the last ten years

Osteoporosis severe enough that intense movements may cause physical problems

Previous physical injuries that are not fully healed and which may be aggravated by intense work

Contagious disease

Use of medication

By accepting the general terms and conditions of sale, the Client declares that they are aware of these contraindications and that they do not have any of the conditions listed above or, if applicable, have obtained the opinion of a healthcare professional who has authorised them to undertake this type of somatic session. Such sessions include breathing work that may at times be intense and the stimulation of certain areas of the body through non invasive touch or a few seconds of massage on an area of tension in the body. The Client assumes full responsibility for their health and well-being throughout the practice and afterwards in case of any symptoms requiring medical advice or consultation.

If it turns out that the Client does not meet the health conditions specified above, the Service Provider reserves the right to modify the session or cancel it depending on the Client’s state of health.

3.2 Course of the session

Sessions are held strictly by prior appointment made via the website https://calendly.com/kleophe
.

Sessions may take place in person in venues occasionally rented for this purpose or remotely via the ZOOM application.

The duration of the session varies depending on the type of support.

3.3 Rescheduling a session

The client may reschedule a session up to forty eight hours (48h) in advance via the website https://calendly.com/kleophe
. The client may reschedule the session up to three (3) times without justification or reason.

If the client reschedules the session more than three times or fails to attend the session at the scheduled date and time, the Service Provider reserves the right to retain the amount due for the session, except in cases of force majeure duly proven and recognised by case law.

  1. Terms and conditions of online masterclasses

Online masterclasses (workshops) are held via the Zoom application. Bookings are made via the link https://calendly.com/kleophe
or the page https://kleophe.podia.com

Payment is made prior to the workshop by online payment via Stripe. A replay is made available at the end of the live session to be downloaded within a period of 7 days. After this period, the client may no longer claim access to the content of the live session. Once the workshop has taken place, no refund will be possible.

The price varies depending on the duration and the theme covered.

In person workshops cover the following themes:

personal development

work with the unconscious

somatic emotional release

nervous system regulation

energy work

These workshops can only be booked in advance online on the website https://calendly.com/kleophe

The date, duration and venue of the workshop are indicated to the client at the time of booking or later by email.

  1. Terms and conditions for the sale of audio and video bundles

The Service Provider offers, for download or limited access by login via the platform https://kleophe.podia.com
, audio and video bundles, as well as replays of masterclasses, in order to help the client release emotions and carry out personal development work independently and at their own pace.

The client selects the desired audio or video bundle. The duration and price of the bundle are indicated to the client directly on https://kleophe.podia.com

Payment for these audio or video bundles is made directly on https://kleophe.podia.com
by online payment via Stripe. Downloading of the bundles is available once payment has been made on the platform https://kleophe.podia.com

The Service Provider cannot be held liable for any technical failure of the website https://kleophe.podia.com
which the client expressly acknowledges.

  1. Terms and conditions for the provision of online programmes

The Service Provider offers, through limited access by login via the platform https://kleophe.podia.com
, online programmes to help clients release emotions and carry out personal development work independently and at their own pace.

The client selects the desired online programme. The duration and price of the programme are indicated on the website https://kleophe.com
and on https://kleophe.podia.com

Payment for these programmes is made directly on https://kleophe.podia.com
by online payment via Stripe. Downloading of the programmes is available once payment has been made on the platform https://kleophe.podia.com

The Service Provider cannot be held liable for any technical failure of the website https://kleophe.podia.com
which the client expressly acknowledges.

  1. Prices

The Service Provider reserves the right to modify session prices at any time.

The prices of the services offered by the Service Provider are those applicable on the day of booking.

Prices are expressed in euros and are exclusive of tax (VAT not included in accordance with Article 293 B of the French General Tax Code). Any change regarding the application of VAT may be passed on immediately.

  1. Payment terms
    9.1 For remote sessions and masterclasses

Payment is made at the time of booking by bank transfer or by bank card via the STRIPE payment platform.

To pay for the Order via STRIPE, the Client will be asked to provide: the price of the products, the quantity, the choice of payment method either via the Client’s STRIPE account or by bank card by indicating the type of bank card (Bleue, Visa, Eurocard or Mastercard), the card number, expiry date and CVV code (the last three digits shown on the signature strip on the back of the bank card), then to proceed to validation.

Note: when paying securely online via STRIPE, the card number is never communicated to the Service Provider. Transmission of payment information is encrypted and secured through the SSL 4 (Secure Socket Layer) protocol, which is the most secure standard currently used by the vast majority of e commerce websites. The client’s payment data will never circulate unencrypted on the Internet. The Service Provider does not store any banking data.

At the end of the payment process, a receipt is sent to the client at the email address provided to the Service Provider at the time of booking. If the client wishes to receive an invoice, they may request one by email at contact@kleophe.com

9.2 For in person sessions and workshops

Payment is made directly to the Service Provider prior to the session by bank card or in cash within the limits provided for in Article L.112 6 of the French Monetary and Financial Code.

At the end of the payment process, a receipt is sent to the client at the email address provided to the Service Provider at the time of booking. If the client wishes to receive an invoice, they may expressly request one from the Service Provider.

9.3 For audio and video bundles and online programmes

Payment is made at the time of ordering on the website https://kleophe.podia.com
via the STRIPE payment platform.

To pay for the Order via STRIPE, the Client will be asked to provide: the price of the products, the quantity, the choice of payment method either via the Client’s STRIPE account or by bank card by indicating the type of bank card (Bleue, Visa, Eurocard or Mastercard), the card number, expiry date and CVV code (the last three digits shown on the signature strip on the back of the bank card), then to proceed to validation.

  1. Withdrawal period

For any remote service, the client has a period of 14 calendar days, including public holidays, from the signing of the client agreement, to withdraw or waive the service by sending an unambiguous declaration expressing their wish to withdraw. Before the end of this period, no one may require or obtain from the client, directly or indirectly, in any capacity or in any form whatsoever, any consideration or commitment.

The client expressly declares that they are aware, in accordance with consumer law, that they will not be able to exercise their right of withdrawal if they have benefited from services that have been fully performed before the end of the withdrawal period and whose performance began with their agreement or express request.

Furthermore, as regards audio and video bundles and online programmes, by signing these general terms and conditions, the client confirms that they are aware of and accept that, in accordance with Article L.221 28 paragraph 13 of the French Consumer Code, they give their prior express consent to the immediate performance of the contract and expressly waive the withdrawal period, since the contract they enter into relates to the supply of digital content not supplied on a tangible medium.

  1. Nature of confidentiality obligations

The Service Provider undertakes towards the client to:

conduct sessions in a professional manner and in a professional setting at all times

handle the client’s name and personal information confidentially and comply with GDPR

treat as confidential all information or questions shared by the client during and outside sessions

before the beginning of any session, explain to the client the nature, purpose, planned duration and cost of the session. No session will be carried out without the client’s informed consent

refer the client to another professional if, during a session, the information disclosed by the client suggests doing so

  1. Client’s duty to cooperate and responsibilities

By signing this agreement, the client:

authorises the Service Provider to use the practices listed in Article 2 during the session. The client understands that these practices and techniques are not medical in nature and that it is their own responsibility to consult their doctor in case of any change in their state of health

understands that sessions are not a substitute for conventional medical care and undertakes to consult their doctor or any other healthcare professional if there are medical reasons requiring it

understands that the Service Provider is not part of the medical profession

understands that any recovery results from their own full responsibility

understands that the Service Provider is only a “facilitator”

understands that it is their responsibility to be open and honest and to provide detailed information that may help achieve the desired results

understands that, through these practices, they may be led to bring changes into their life by the action of their own higher subconscious and that such information and or advice do not occur through the action of the Service Provider but through their own action

Except in cases of gross negligence or serious professional misconduct by the Service Provider, by signing the client agreement, the client or their representative agrees to release the Service Provider from any claim or liability of any kind arising from the session carried out.

The client also:

authorises the Service Provider to use and or share any information and or any story arising from the session in video form or written form in blogs, books or private forums, provided that their name and personal and identifying details are omitted or altered

understands that the session will be digitally recorded and then provided to the client for their personal use

authorises the Service Provider, in the event of a remote session, to record the session in video form in any private location, including their home (only at the client’s request)

  1. Protection of personal data

In accordance with Articles 6 III and 19 of French Law no. 2004 575 of 21 June 2004 on Confidence in the Digital Economy (L.C.E.N.), and in accordance with the European General Data Protection Regulation (GDPR), clients are hereby informed that the Service Provider collects personal data in the course of their activity. The client may at any time request the modification or deletion of their personal data by sending an email to contact@kleophe.com

  1. Mediation

In case of dispute or dissatisfaction, the Client may contact the Service Provider at the following email address: contact@kleophe.com
The Client and the Service Provider will endeavour to find an amicable solution.

Any dispute or disagreement relating to the validity, interpretation, performance, non performance, suspension or termination of these terms and conditions shall be submitted to mediation. The client may refer the matter to the mediator under the conditions provided for in Title I of Book VI of the French Consumer Code within one year from the date of their written complaint.   1. Applicable law and jurisdiction

These general terms and conditions of service are drafted in French and governed by French law.

In the event of a dispute that cannot be resolved amicably or through the mediator, the competent court shall be the court within whose jurisdiction the registered office of the Service Provider is located.
